On-the-spot fines for non-compliance moves closer

The introduction of fixed payment notices, or on the spot fines, for non-compliant refinishers has moved closer, with legislation now awaiting final approval. It is hoped that this process can be completed before the summer recess of the Oireachtas.


Dr Ian Marnane, Senior Inspector at the Office of Environmental Enforcement at the EPA says that both the EPA and local authorities continue to make progress on the enforcement of amendments to The Solvent and Decorative Paint Regulations of 2012, which introduced stricter penalties for non-compliance and a new inspection regime. He comments, “Feedback on the new National Panel of Approved Assessors has been positive and these inspectors have also been able to pass on useful information for bodyshops on common compliance problems.” He adds, “Fixed payment notices will be another important enforcement step and will put significantly increased pressure on any non-compliant refinishers or suppliers.”

The Approved Assessors have also been working with the local authorities in an effort to target repairers operating outside the law and encouraging these bodyshops to become certified. This policy appears to be working well in many areas.  Ian says that he also continues to urge concerned parties to report any non-compliant refinishing activity they are aware off. He comments, “If you know of bodyshop operations which do not comply with regulation please let us know by passing on details to The National Environmental Complaints Line.”
